This Privacy Notice aims to inform you about the data processing in connection with our website and related services. The processing of personal data takes place exclusively within the framework of the respective valid legal data protection regulations, in particular the General Data Protection Regulation (hereinafter referred to as "GDPR").

1. General information

1.1 Personal data

In accordance with Art. 4 (1) GDPR, “personal data” means any information relating to an identified or identifiable natural person (hereinafter referred to as the “data subject”; a natural person is considered as being identifiable, directly or indirectly, in particular by means of an identifier such as a name, an identification number, location data, an online identifier or one or more special characteristics expressing the physical, physiological, genetic, mental, economic, cultural or social identity of this natural person.

2. Collection and processing related to our website

2.1 Automatically processed data when visiting

Each time you access our website, your browser automatically transmits data that are stored in the log files of the server. This includes the following data (hereinafter referred to as the "Log file data"):

  • Information about browser type and browser version;
  • operating system of the user;
  • Internet service provider and IP address of the user; and
  • date and time of the access.

The Log file data is anonymised and then evaluated on a continuous basis in order to improve the website, to adapt the website to the interests of our users and to be able to remedy errors quickly. For these purposes, the legal basis for the processing of data is our legitimate interest pursuant to Art. 6 (1)(f) GDPR.

In a non-anonymised form, Log file data are used solely to detect malfunctions and to ensure system security, including detection and tracking of improper access attempts and fraud and abuse attempts. The data are stored for 7 to 14 days and then deleted. On occasions, we require the further storage of Log file data for evidence purposes so this will not be deleted until final clarification of the respective incident has been obtained and may in individual cases be forwarded to the investigating authorities.

2.2 Processed data when using the online shop

If you actively submit data to us, for example by registering with our online shop or placing an order, we will process the data transmitted by you.

When registering for our online shop or when using the online shop, we collect and process the following information from you:

  • title;
  • name;
  • address;
  • telephone number;
  • password;
  • as well as date of birth (voluntary); and
  • order history.

When ordering, we also process the following information:

  • items ordered;
  • delivery address, if different; and
  • invoice and payment data.

We process the above data in order to update your registration and to process your orders. The legal basis for processing this data is performance of a contract pursuant to Art. 6 (1)(b) GDPR.

We store the data collected for the purposes of performing the contract until the expiry of the statutory or any contractual warranty and guarantee claims. Thereafter, we store the information required by commercial and tax law for the statutory periods of time for the sole purposes of making it available to the tax authorities in the event of an audit being.

Your payment data will be forwarded to the respective payment service provider for payment processing.

If you pay via PayPal, you will be redirected to PayPal's website via a link. With regard to payment processing, the data processed relate to your name, your address, your e-mail address, any telephone numbers and account or credit card information. If you have a query regarding the use of your personal data by PayPal please refer to the General Terms and Conditions, Terms of Use and Privacy Notice of PayPal (Europe) S.à rl et Cie, SCA, 22-24 Boulevard Royal, L-2449 Luxembourg on the website: www.paypal.com.

Orders for Miele calendars are processed via external service providers, to whom any payments are also to be made. These service providers act on our behalf and following our instructions.

The delivery address will be forwarded to the delivery partner appointed by us. So that the delivery partner can contact you to coordinate the delivery date or in the case of delivery problems, we will provide the delivery partner with your e-mail address and, if applicable, telephone number. The respective data are transmitted solely for the respective purposes and are deleted after delivery. Some of our delivery partners offer track-and-trace services. We will transfer your e-mail address to the delivery partner in order to enable our partner to provide its track-and-trace services to you. The legal basis for the processing of the data is the consent pursuant to Art. 6(1)(a) GDPR. 

2.3 Collection service

In the event that you are in default of payment despite repeated reminders, we reserve the right to forward the data required for the execution of a collection to a debt collection agency for the purpose of fiduciary collection or to sell the outstanding claims to a collection service provider. In the event of a sale, the collection service provider becomes the holder of the claim and asserts the claims in its own name. The legal basis for the transfer of data in connection with the fiduciary collection is performance of contract pursuant to Art. 6 (1)(b) GDPR and for the transmission of data in the context of the sale of a claim our legitimate interest pursuant to Art. 6 (1)(f) GDPR.

2.4 Credit check

Our company regularly checks your credit status for contracts and –in cases where we have a legitimate interest – even for existing customers. For this purpose, we work together with a service partner from which we receive the necessary data. In order to perform the above, we will transmit your name and contact details to our service partner. The legal basis for the data processing is our legitimate interest pursuant to Art. 6 (1)(f) GDPR.

2.5 Miele Club

If you register for the Miele customer program Miele Club, we will collect the following customer data as part of the registration:

  • title;
  • name;
  • address;
  • telephone number;
  • password;
  • and date of birth (voluntary).

We process these customer data for the purpose of providing our customer programme. The legal basis is performance of contract pursuant to Art. 6 (1)(b) GDPR.

We store the customer data during your membership in our Miele customer program Miele Club.  Thereafter, we store the customer data only and insofar as we are obliged to store it for reasons based on commercial and tax law.

2.5.1 Prize promotions

If you enter into any of our prize promotions, we will collect the information we need to check your eligibility for a particular promotion. This will typically include:

  • Title;
  • Name;
  • Address;
  • Telephone number;
  • Information about the Miele product you have purchased.

We will process that data for the purposes of entering you into and administering the prize promotion. The legal basis is performance of contract pursuant to Art. 6(1)(b) GDPR, being our prize promotion terms.

We may engage third parties, such as Grand Central Creative to administer prize promotions and to process your personal data on our behalf. We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

Any further use of your personal data, including for the purposes of research, analytics or commercial communications is as described elsewhere in this privacy policy.

2.6 Commercial communication

If and insofar as you have given us your consent for marketing and advertising purposes, e.g. you have signed up to the e-mail newsletter, customer satisfaction surveys, app-notification, Miele Club newsletter etc., or we are otherwise allowed to process your data for the aforementioned purposes on the legal basis of our legitimate interest, the data processing required in the context of establishing contact takes place on the legal basis of your consent, Art. 6 (1)(a) GDPR or our legitimate interest, Art. 6 (1)(f). It might be possible that commercial communication will be provided through our external service providers. These service providers act as instruction-bound processors for us. You may object the processing of your data for these purposes or revoke your consent to us at any time with effect for the future (e.g. by using the unsubscribe link included in the e-mail or write us an e-mail or letter).

2.6.1 Basic Personalisation

If and to the extent that you have given us your consent, we will process the contact data you have provided (your e-mail address and name, phone number and/or Miele Account, if applicable) for the purpose of sending the basic commercial communication via email, SMS or the Miele Apps.

Additionally, we will process receipt and read confirmations received via the commercial communication, as well as information about the links you clicked on. If you click on a link within the commercial communication, we also process information collected by cookies about your user behaviour on the website, which you can access via a link within the commercial communication sent. We store this information about your user profile and use it to better tailor the content of our commercial communication to your personal interests. We store this personalisation information for this purpose for 2 years.

As part of the basic commercial communication, we will inform you about news in the Miele range of products, events organised by Miele, customer surveys in which you can take part, product rating and review requests for purchased Miele products and recipes, all tailored to your interests. For product rating and reviews see also our related part “Product Rating and Reviews” below in this privacy policy and the corresponding terms of use.

We will inform you about Miele events in the vicinity of your place of residence based on the postal code of your place of residence that you have provided.

Furthermore, we will process your interests in specific Miele products and services that you may have submitted in the context of the registration for the commercial communication.

Taking into account any Miele appliances or Miele products you may have already purchased and will purchase in the future from Miele or register and will register, (add to your Miele account), respectively, Miele tailors the subscribed commercial communication to your interests/needs. This includes, among other things, reminders of a warranty extension and the redemption of the voucher for consumables enclosed with the respective device. For that purpose we process also your order history.

Miele processes your order history (as far as relevant also retrospectively) for five years.

The legal basis for this processing is your consent, Art. 6 (1)(a) GDPR. We store the contact data and your consent for the stated purposes for five years after each use.

You can revoke your consent at any time with effect for the future. In addition, every e-mail sent to you contains an unsubscribe link which use also declares your revocation. In the Miele apps, there is a corresponding option to log off in the settings.

2.6.2 Advanced Personalisation

In order to respond to your individual needs, we process the Miele services you have used and will use in the future (e.g. delivery and/or installation service, maintenance work as well as individual product advice and contacting Miele customer service) and technician assignments commissioned by you. As part of the information on technician assignments, Miele processes the details of the respective repair order, the reason for the damage and any remedial measures (repairs) carried out.

We store that information (advanced personalisation) for this purpose for 3 years. The legal basis for this processing is your consent, Art. 6 (1)(a) GDPR.

2.6.3 Complete Personalisation

For our complete personalisation, we process the data from our commercial communication as described in detail above and the following data:

Data collected using Firebase for Google Analytics regarding your use of our Miele apps, e.g.: opens, clicks and reading time; Further information can be found in the respective app - your data will only be processed if you have given us your consent to evaluate the usage data in the respective app

Data collected during your visits to our website  using the Bloomreach Engagement solution, such as your usage behaviour (e.g. products viewed, products in the shopping cart, product advisor etc.) - your data will only be processed if you contact us and have given your consent to the collection of data via cookies and similar tracking technologies and to the evaluation of usage data when you visit our website.

We only process this usage data if we have collected it for advertising purposes based on your separate consent and may link it to your user profile.

We store this information (complete personalisation) for this purpose for 2 years. The legal basis for this processing is your consent, Art. 6 (1)(a) GDPR. You can revoke your consent at any time with effect for the future. You can declare your revocation at any later time in writing (Miele Co Ltd, Fairacres, Marcham Road,Abingdon, Oxfordshire, OX14 1TW) or by email without giving reasons. In addition, every e-mail sent to you contains an unsubscribe link which use also declares your revocation. In the Miele apps, there is a corresponding option to log off in the settings.

2.6.4 Commercial after-sales contact

If we have received your e-mail address in connection with ordering goods or services, we will also process your e-mail address in order to inform you about similar goods or services by e-mail in the future. You can request at any time that you no longer receive such informational e-mails from us (right to object). To do this, please send an e-mail to info@miele.co.uk or to the contact details given in the imprint or click on the link at the end of the information e-mail. You will not incur any costs other than the transmission costs according to the basic tariffs. Our legal basis to process your data is our legitimate interest in direct marketing to inform you about similar products and services Art. 6 (1)(f) GDPR.

 

3. Creating analyses and evaluations for internal reports and statistical purposes

We consistently strive to gain a better understanding of our customers’ needs and wishes, and to align our products, services and marketing activities with these as far as possible.

To do this, where necessary we process the data of yours described below in order to create our own internal statistics for our internal reporting and our own market research so that – for example – we can improve our products and services, adapt our range, gauge campaigns and sales channels, and perform general purchase analyses (our legitimate interest in this processing is based on Article 6(1) (f) GDPR). We engage the services of our affiliated companies Miele & Cie. KG and Miele X B.V. to act as processors (as outlined in Article 28).

In this context, we distinguish between two different processes:

  • Pseudonymised analyses of purchase data
    The data we use from purchase histories (order numbers, customer numbers and codes from redeemed vouchers, where applicable) is pseudonymised and has any personal data removed from it.
  • Anonymised analyses based on customer groups
    To do this, we process the following in addition to the data above:
    • The number and type of registered appliances per customer account, the customer’s form of address and the postcode shortened to three characters

Where we process data based on your consent to commercial communication (see 2.6.1 to 2.6.3, 2.2):

  • Campaign history data, newsletter opening and click data (see “Basic Personalisation”), aggregated behaviour data from our websites (see “Complete Personalisation”), year of birth and any services used or technician work commissioned

Based on your Miele Club membership, if this exists (see 2.5):

  • The duration and status of your Miele Club membership (see “Miele Club”), year of birth assuming that we are already processing the data with permission and are identifying and using anonymised customer group models.

Your personal data will be anonymised in the context of processing. The data will not be analysed and evaluated in analysis systems until it has been anonymised; this means that it will be analysed and evaluated without reference to any personal details.

The aggregated reports and statistics do not allow identification of a specific person under any circumstances, and will be shared with other companies in the Miele Group.

The legal basis for this is Article 6(1) (f) GDPR. Our legitimate interest is in the purposes described above. As a general rule, our actions – particularly pseudonymisation and anonymisation – only have a minor impact on your rights and freedoms, which means that they do not routinely outweigh our legitimate interests in processing. However, you may object to the processing of your personal data for these purposes at any time, at which point we will stop processing it. You can exercise your right of objection by sending us your notification in any format – such as an e-mail or letter – to the contact details referred to above. For more information on exercising your right of objection, see “Right of objection” below.

Personal data will only be stored for the purposes described for as long as is required to fulfil these purposes, unless any applicable laws state that we are obligated to process the data for longer.

 

4. Product Rating and reviews

On our website we use the services of Yotpo UK Ltd (Tagwright House, 35-41 Westland Place, London N1 7LP, United Kingdom), to collect and display ratings and reviews of customers for products they have purchased. We share the personal data described below to Yotpo, so that Yotpo can provide all the functionalities of these services. Yotpo acts as a processor on our behalf and acts upon our instructions.

If you have provided us your consent for basic commercial communication, within the context of these services, we collect and process personal data, such as order ID, order date, and your e-mail address. This data is processed with the purpose of sending you e-mail communications, requesting you to provide rating and reviews regarding the products you have purchased. Additionally, it helps us confirm the legitimacy of the purchaser and to ensure authenticity. If you do not submit a review, the aforementioned personal data will be retained for 90 days following the email requesting your review. The legal basis for this processing is your consent, as described in Art. 6(1)(a) GDPR.

If you submit a review on our website, within the framework of these services, we collect and process personal data, such as review title, review content, order ID, order date, reviewed and purchased product, reviewer display name, reviewer e-mail address, and personal unsubscribe token. Published reviews will be displayed on the relevant product detail page. The retention period of the personal data associated with your ratings and reviews is contingent upon various factors, including product popularity, lifecycle, and potential delisting of a product. While certain reviews, such as kitchen appliances, may be kept for up to 20 years, the specific timeframe is determined by an evaluation of individual product attributes, popularity trends, and whether the product remains listed or is delisted. The legal basis for the data processing is your consent, as described in Art. 6(1)(a) GDPR, and contract, Art. 6(1)(b) GDPR; you can find the Terms of Use Product Ratings and Reviews here. Please ensure that you only provide information relating to your opinion and experience of our products in the input field provided and do not provide any personal or sensitive data about yourself in the input field.

You can revoke your consent at any time with effect for the future. 5. Contact and customer service

5.1 Contacting us

Our website lists different ways that you can contact us. Furthermore, you can contact us through our social media presences (e.g. on Facebook or Instagram). If you use these and contact us e.g. by e-mail, we will process the data you provided to us in order to answer your request.

We have a legitimate interest in answering your enquiries. The legal basis for the data processing is therefore our legitimate interest pursuant to Art. (6)(1)(f) GDPR. If the purpose of your request is to conclude a contract, the legal basis is performance of contract pursuant to Art. 6 (1)(b) GDPR.

When contacting us, data transmitted to us will be deleted after completion of your request, provided and insofar as we are not obliged to store it for reasons based on commercial and tax law.

5.2 Digital Miele Assistant

The Digital Miele Assistant is a so-called chatbot provided by our technical service provider, e-bot7 GmbH, Perusastraße 7, 80333 Munich. The Digital Miele Assistant will assist you in the search for information on and purchase of Miele Service Packages, such as the Miele Service Certificate, Coffee Care or Exclusive Care Packages. You can simply enter your questions in the chat window. The Digital Miele Assistant will then provide you with answers. If you would like to request a Miele Service Certificate, the Digital Miele Assistant will send you a link to the appropriate web form.

The Digital Miele Assistant does not answer any contract-specific customer requests. If you have any such enquiries, please contact our customer service (https://www.miele.co.uk/f/uk/contact-next-gb.aspx). Personal details are neither required nor requested in order to use the Digital Miele Assistant. At the most, information about the respective appliance type is collected but not appliance identification, e.g. via a serial number, which is necessary for the Digital Miele Assistant.

We process your data to deal with your concerns and to control and improve our business and service processes, including the Digital Miele Assistant, which is our legitimate interest. The legal basis for the processing is Art. (6)(1)(f) GDPR. If you purchase a Miele Service Certificate or another Miele Service Package, the legal basis for data processing is Art. 6 (1)(b) GDPR. E-bot7 GmbH acts as a processor on our behalf and acts upon our instructions.

The questions you ask the Digital Miele Assistant, as well as the usage data, i.e. chat duration, time stamp of the messages, number of dialogues and approximate location of the users, are stored for a maximum of 90 days. After that, your questions will be deleted irrevocably. In addition, the usage data are stored anonymously for statistical purposes. Personal data are not evaluated.

5.3 Miele Customer Service

You can contact Miele Customer Service in various ways, e.g. by telephone or online. In this case, we will process the data you submit to us as part of your request. Insofar as is necessary for the provision of customer service, for example, to collect the device from you, to carry out repair work or to process warranty or guarantee claims, your data will be forwarded to our service partners.

The legal basis for the processing of your data in the context of customer service is performance of contract pursuant to Article 6 (1) (b) GDPR.

With regard to customer service, data transmitted to us will be deleted upon expiry of the corresponding warranty or guarantee periods, provided and insofar as we are not obliged to store them for a longer period for reasons based on commercial and tax law.

5.4 Go Instore

On our website we use the Go Instore services provided by Sym-Sys Ltd (t/a Go Instore), 1 Phipp St., London, EC2A 4PS, United Kingdom. By using this service, you will be connected with our Miele Experience Center in order to get a digital presentation of our products. You just have to activate your microphone. The video/audio stream will not be stored. In this context, your personal data (IP-address and further information you shared with our MEC Team) will be processed. We have a legitimate interest in answering your enquiries. The legal basis for the data processing is Art. (6)(1)(f) GDPR. If the purpose of your request is to conclude a contract, the legal basis is Art. 6 (1)(b) GDPR. In the event you also agree to the use of analytics cookies, we will use your interaction with our Go Instore services and your corresponding use of our webshop for sales attribution purposes. When contacting us, data transmitted to us will be deleted after completion of your request, provided and insofar as we are not obliged to store it for reasons based on commercial and tax law. Furthermore, we use cookies for the service. 6. Cookies

We also use cookies or similar technologies on our website, such as pixels (hereinafter referred to as "Cookies"). Cookies are small text files stored by your browser on your device, or image files, such as pixels. The next time you visit our website with the same device, the information stored in cookies will either be returned to our website (hereinafter referred to as "First Party Cookies") or to another website (hereinafter referred to as "Third Party Cookies").

The information stored in the cookies tells the website that you have already visited it. This allows us to display the website in the best possible way in accordance with your preferences. Only the Cookie itself is identified on your terminal. In addition, personal data will be processed only after your explicit consent or if absolutely necessary in order to be able to use the service offered and requested by you accordingly.

You can disable certain Cookies on our Cookie settings page. Furthermore, you can generally prevent the storage of Cookies by setting your browser software accordingly; in that case, you may not be able to use all features of our website to their fullest extent.

We inform you about the use of cookies in advance with a corresponding note on a banner.

 

7. Analysis and targeting tools

7.1 Google services

On our website, we use various services provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (hereinafter referred to as "Google").

7.1.1 Google Analytics

Our website uses Google Analytics for the needs-oriented design and improvement of the website. Google Analytics uses so-called cookies that are stored on your terminal and that allow an analysis of the use of the website by you. The information generated by the cookie is usually transmitted to a Google server in the US and stored there. We use the extension of IP anonymisation (referred to as IP masking) on this website, i.e. your IP address is shortened by Google within Member States of the European Union or in the other States that are party to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be sent to a Google server in the US and shortened there.

On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide other services related to website activity and Internet usage to the website operator.

The legal basis for the data processing is legitimate interest pursuant to Art. (6)(1)(f) GDPR.

Google's services also include reporting on the effectiveness of our advertising efforts (including across devices), the demographics and interests of our users, and cross-device delivery features of online advertising when you have a Google Account and personalised advertising (hereinafter referred to as "personalised ads"). In this case, the legal basis of data processing is the consent you granted to Google (Art. 6 (1)(a) GDPR).

You may object to the collection or analysis of your data by Google Analytics by downloading and installing the browser plug-in available under the following link: https://tools.google.com/dlpage/gaoptout.

The data sent by us and linked to cookies, user identifiers (e.g. user ID) or advertising IDs will be automatically deleted after 14 months.

7.1.2 Google Remarketing Features

Google's remarketing feature allows us to show our users advertisements based on their interests on our other websites within the Google Ads Network (so-called "Google ads" or ads on other websites). For this purpose, the interaction of the users on our website is analysed in order to be able to show users targeted advertising even after visiting our website on other sites. Google stores a number in the browsers of users who visit certain Google services or websites on the Google Display Network. This number records the visits of these users.

The legal basis for the data processing is legitimate interest pursuant to Art. (6)(1)(f) GDPR.

7.1.3 Google Conversion Tracking

We also use Google's Conversion Tracking in this context. When you click on an ad served by Google, a 30-day conversion tracking cookie will be placed on your device. These cookies are not for personal identification. The information gathered using the conversion cookie is used to generate conversion statistics for Google Ads advertisers.

The legal basis for this data processing is legitimate interest pursuant to Art. (6)(1)(f) GDPR.

You can disable Google interest-based ads on your browser by turning off https://www.google.com/settings/ads or opting out of https://www.aboutads.info/choices/.

7.1.4 Further Services of the Google Marketing Platform

In addition, our website uses further services of the Google Marketing Platform (formerly “Google doubleclick”). These services use cookies to serve ads that are relevant to users, to improve campaign performance reports or to prevent a user from receiving ads multiple times.

Google uses a cookie ID to record which ads are played in which browser and thus prevents them from being displayed multiple times. In addition, Google can use cookie IDs to track what are known as conversions, i.e. whether a user sees an advertisement and later goes to the advertiser's website and buys something there. According to Google, such cookies do not contain person information.

Your browser automatically establishes a direct connection to the Google server. We have no influence on the extent and further use of the data collected through the use of this tool by Google. According to Google, through the involvement of this services, Google receives the information that you have accessed the relevant part of our website or clicked on an ad from us. If you are registered with a service of Google, Google can assign the visit to your user account. Even if you are not registered with Google or have not logged in, there is a chance that the provider will find out and store your IP address.

In addition, the Google cookies allow us to understand whether you are performing certain actions on our website after you have viewed or clicked on one of our ads on Google or on another platform (Conversion Tracking) (“Floodlight”). This includes information about the website and the referencing URL, the date and time of the visit to the website and technical information in the form of screen resolution, operating system, browser type and device type, as well as the country and town from which the website was accessed. The users' IP address or form information will not be used for this purpose.

On our website we use Hotjar by Hotjar Ltd (“Hotjar”), Dragonara Business Centre, 5th floor, Dragonara Road, Paceville St Julian’s STJ 3141 Malta, that provides Software as a Service (SaaS), a third-party analytics service, to help us understand how visitors engage with our website and to optimize this service and experience.

Hotjar may collect and process data on our behalf, including clicks, mouse movements, and scrolling activity, what users do and don’t like, information about your device and browser, IP address (collected and stored in an anonymized format), unique device identifiers, referring URL and domain, pages visited on, geographic location (country only), and the preferred language used to display our website. Hotjar stores this information on our behalf in a pseudonymized user profile. Hotjar is contractually forbidden to sell any of the data collected on our behalf.

Hotjar acts as a data processor, and we as a controller in accordance with the GDPR.

All data collected by Hotjar is stored in the European Economic Area. However, it might be possible the data will be transferred to sub-processors outside the EEA and/or the United Kingdom (“Third Countries”). There will be certain safeguards to ensure that the data is protected in accordance with the requirements of the GDPR.

7.6 Trade Desk Pixel

On our website, we use the Trade Desk Pixel, provided by The Trade Desk Ltd (“Trade Desk”), 10th floor, 1 Bartholomew Close, London EC1A 7BL, United Kingdom, a snippet of JavaScript code that allows us to track your activities on our website and facilitates the use of technology that helps us with digital advertising by a Demand Side Platform (“DSP”).

The purpose for processing the data is for advertising purposes including personalizing ads, delivering ads, limiting the number of times you see an ad, measuring effectiveness of ads, reporting on ad campaigns and maintaining ad transaction records.

The processing of the data takes place in accordance with applicable data protection laws and regulations, such as the General Data Protection Regulation (“GDPR”). The legal basis of the data processing is the consent pursuant to Art. 6 (1)(a) GDPR).

Trade Desk collects and uses data, on our behalf, to ensure that the ads you see are relevant and to measure and report on their effectiveness. The platform uses data to produce a mapping of devices that might be related to each other. This means that they might be used by the same person or by people within the same household. This helps us to better target and measure our campaigns, as well as to limit the number of times the same person or household sees an ad.

Trade Desk acts as a data processor, and we as a controller in accordance with the GDPR.

Trade Desk may collect and process pseudonymous data, on our behalf, about users, households, devices and ads and where they’re shown, including unique cookie identifiers, device advertising identifiers, pseudonymous identifiers derived from email address or phone numbers, IP addresses, interest and demographic information stored and/or used on the Platform, interest and demographic information they create or infer, other information about browsers and devices, such as type, version and settings, location information based on IP address or other types of information that may include precise geolocation information (i.e., latitude/longitude coordinates), if provided, the browser and device information type, version and settings, hashed email addresses and other identifying information (or information derived from such).

8. Social media plugins

As far as we know Facebook stores the data collected about you as usage profiles and uses them for purposes of advertising, market research and/or tailor-made website design. Such an evaluation is carried out in particular (also for non-logged-in users) for the presentation of needs-based advertising and to inform other users of the social network about your activities on our website. When you use Twitter, your personal data are collected, transmitted, stored, disclosed and used by Twitter, transmitted, stored and used wherever you reside in the United States, Ireland and any other country in which Twitter operates.

We have no influence on the processing of the collected data, as it is performed solely by YouTube. According to information provided by YouTube, the data collected includes, among other things, the IP address, operating system information, hardware versions and browser type, data collected from YouTube cookies about your user behaviour, and other technical data. 10. Job applications

If you apply via the Miele application portal or form or otherwise for a position with us and send us application documents, we will process the personal data you provide in this context only for the purpose of the application process.

Insofar as you have applied for an advertised position, the documents will be automatically deleted six months after completion of the application procedure, provided deletion does not conflict with our legitimate interests. In the case of an application without reference to an advertised position (unsolicited application), the application will be kept for a maximum period of one year in order to contact you, if necessary, with regard to a vacancy that arises during this time. At any time you have the option of requesting the deletion of your application prior to expiry of the scheduled retention periods. In the case of a successful application, the data provided to us will be stored in your employee file in compliance with the legal requirements.

If you have applied for an position with another Miele Group company, we will forward your application to the respective company for the purpose  of deciding on the establishment of an employment relationship.

As far as we process your data for the decision on the establishment of an employment relationship, the legal basis the performance of our employment contract with you and our legitimate interests of managing our relationship with you (where the processing activities are not strictly speaking necessary for the performance of a contract.

In all other cases, the legal basis for storing your application data is your consent in accordance with Art. 6(1) lit. (a) GDPR.

11. Miele trade fair presence

If you visit one of our booths, we collect your data if you provide us with such, e.g. by handing over your business card. We process these data to respond to your queries, e.g. contact for further discussions or offers. If this is necessary to respond to your queries (e.g. when requesting a contact abroad), we will forward your data to the responsible person of the respective company of the Miele Group.

We have a legitimate interest in answering your enquiries. The legal basis for the data processing is our legitimate interest pursuant to Art. (6)(1)(f) GDPR. If the purpose of your request is to conclude a contract, the legal basis is performance of contract pursuant to Art. 6 (1)(b) GDPR. If you give us your consent for such, the legal basis is Art. 6 (1)(a) GDPR. You may revoke your consent at any time with effect for the future.

When contacting us, data transmitted to us will be deleted after dealing with your request, provided and insofar as we are not obliged to store it for reasons based on commercial and tax law.

At our booths, we also occasionally take pictures and film recordings for documentation, marketing and press purposes, which are then published via i.a. our social media channels (e.g. Facebook, YouTube or Instagram). In this case, we expressly point this out to you by posting a notice on the stand. You may revoke any consent granted to us regarding the use of an image at any time with effect for the future.

12. Access to your personal data

Within the context of the data processing described in this privacy notice, it might be possible that we transfer personal data to the following categories of recipients (in addition to the recipients expressly stated in this privacy notice):

  • authorized agents and other consultants (e.g. attorneys, tax accountants, auditors);
  • service providers;
  • companies of the Miele Group (https://www.miele.com/en/com/subsidiaries-2156.htm);
  • insurance companies; and
  • state agencies and governmental bodies.

We only transfer personal data to third parties insofar it is required to fulfil our contractual obligations, in case we have or the respective third party has a legitimate interest in processing the personal data or if you have given consent to the transfer. Furthermore, we only transfer personal data to third parties if and insofar we are obligated to do so according to applicable law, regulatory action or court order.      

13. Your Rights

Data subjects have various rights under the GDPR where certain conditions apply. These include in particular:

  • Right to access: According to Art. 15 GDPR, you can request a confirmation as to whether personal data concerning you is being processed by us. If such processing is available, you may also request further information about the processing from us.
  • Right to rectification: In accordance with Art. 16 GDPR, you are entitled to rectification and/or completion if the processed personal data concerning you is incorrect or incomplete.
  • Right to restriction of processing: You may request, pursuant to Art. 18 GDPR, that the processing of your personal data be restricted.
  • Right to erasure: According to Art. 17 GDPR, you also have the right under certain circumstances to demand the deletion of your personal data stored about you.
  • Right to data portability: In accordance with Art. 20 GDPR, you are also entitled to receive the personal data that you have provided in a structured, common and machine-readable format and to transmit it without any obstruction from us to another controller.

You have the right to complain about the handling of your personal data  to a data protection authority.

15. Right of objection

If your personal data are processed on the basis of legitimate interests pursuant to Art. 6(1)(f) GDPR, you have the right to object to the processing of your personal data in accordance with Art. 21 GDPR, provided there are reasons for this arising from your particular situation or if your objection is based on being targeted to marketing purposes. In the latter case, you have a general right of objection, which is implemented by us without any particular situation being specified.

 

Buyers Guide

On our website, we use Guided-Selling-service provided by our service provider Neo Commerce GmbH, Max-Bill-Str. 8, 80807 Munich, Germany („Neocom“). The Guided-Selling- service helps you to find the right product faster and more efficiently. After only a few questions, initial product suggestions are made. The products get populated based on how well it fits your needs. You are free to decide whether you like to use the service. In this context, we only process meta data of an HTTP Web request as referrer, your IP-address, browser language and user agent (browser/ OS type & version) and your data shared with us by using the service. The data will not be stored. We process your data in order to provide you the service. The legal basis for the processing is Art. (6)(1)(a) GDPR. If you purchase a product, the legal basis for data processing is Art. 6 (1)(b) GDPR. Neocom acts as a processor on our behalf and acts upon our instructions.

In the context of the use of services, we also store information in your session storage, mainly in order to identify a user throughout multiple browser sessions. Qualtrics

On our website, we use the services of Qualtrics LLC, 333 W. River Park Drive, Provo UT 84604, USA to conduct customer, product, and brand surveys in order to regularly improve our products and services. When taking a survey, we will process log data, including date, timestamp, browser information, browser settings, device details, and usage data (which includes the distinction between customers and guests during the checkout process). Additionally, when you initiate a search on our website, we collect the data what you type after the "?text=" component in the URL (e.g., https://www.example.co.uk/search?text=example). This information helps us in understanding your search behaviour and is correlated with your survey responses in Qualtrics to assess the effectiveness of your search experience, ultimately guiding us in enhancing our services and product.
